Gardeners Hoxton Service Terms and Conditions

These Terms and Conditions set out the basis on which Gardeners Hoxton provides gardening and related services to residential and commercial customers within its service area in the United Kingdom. By making a booking, accepting a quotation, or allowing work to commence, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 Gardeners Hoxton, we, us and our refer to the gardening business trading under the name Gardeners Hoxton.

1.2 Client, you and your refer to the person, company or organisation requesting or receiving services from Gardeners Hoxton.

1.3 Services means gardening, garden maintenance, planting, clearance, lawn care, hedge cutting, soft landscaping, garden tidy-ups and any other work agreed between Gardeners Hoxton and the Client.

1.4 Service Area means the geographical area in which Gardeners Hoxton offers services, primarily covering Hoxton and surrounding neighbourhoods, as determined by Gardeners Hoxton from time to time.

1.5 Agreement means the contract between Gardeners Hoxton and the Client, comprising these Terms and Conditions together with any written quotation, booking confirmation or scope of work.

2. Scope of Services

2.1 Gardeners Hoxton will provide the Services with reasonable care and skill, in accordance with good horticultural practice and the description set out in the quotation or booking confirmation.

2.2 Any images, descriptions or examples of work are for illustrative purposes only. Actual results may vary depending on site conditions, weather, soil quality, existing planting and ongoing maintenance by the Client.

2.3 We reserve the right to decline any job that we consider unsafe, unlawful, unsuitable for our expertise, or beyond reasonable access or capability with the tools available on the day.

3. Booking Process

3.1 Bookings may be made by the Client through our accepted contact and booking methods as made available from time to time.

3.2 A booking is not confirmed until we have provided explicit confirmation, which may include a written quotation, a fixed price agreement, or a stated hourly rate, together with an agreed date or time window for attendance.

3.3 For larger or more complex work, a site visit may be required before a quotation can be issued. Site visits may be chargeable or free at our discretion and the Client will be informed in advance if a charge applies.

3.4 By confirming a booking, you confirm that you are the owner of the property or are otherwise authorised by the owner or occupier to commission the Services.

3.5 It is the Client’s responsibility to provide accurate information about the property, access arrangements, parking, and the nature of the work required. Additional charges may apply where information provided was incomplete or inaccurate.

4. Quotations and Pricing

4.1 Quotations are normally valid for 30 days from the date of issue unless stated otherwise. After this period, prices may be revised to reflect changes in labour, materials or other costs.

4.2 Quotations may be provided as a fixed price for a defined scope of work, or as an estimate based on an hourly rate with an indicative number of hours. Where work is charged by the hour, the final price will reflect the actual time spent on site, subject to any minimum charge.

4.3 Quotations do not include the cost of waste removal, materials, plants, parking or congestion charges, unless this is clearly stated. These items may be charged separately.

4.4 If, after work commences, additional work is requested or required due to hidden conditions, safety concerns or inaccurate initial information, Gardeners Hoxton may revise the quotation or charge for the additional work at the prevailing rates. Any significant change in cost will be discussed with the Client where reasonably possible.

5. Access, Parking and Site Conditions

5.1 The Client must ensure that Gardeners Hoxton has safe and reasonable access to the property and to the areas where work is to be carried out, including access for tools, equipment and, where necessary, vehicles.

5.2 The Client is responsible for providing suitable parking arrangements for our vehicles where required. Any parking fees, permits or penalties incurred as a direct result of the Services being carried out may be charged to the Client.

5.3 The Client must notify us of any known hazards or restrictions on site, including uneven surfaces, fragile structures, underground services, ponds, or areas that must not be accessed.

5.4 Gardeners Hoxton reserves the right to suspend or modify the work if site conditions are unsafe, inaccessible, or significantly different from those described at the time of booking.

6. Client Responsibilities

6.1 The Client shall ensure that all necessary permissions, consents and approvals for the work have been obtained, including planning permissions, landlord or freeholder consents, and permissions from neighbours where necessary.

6.2 The Client must ensure that pets, children and other occupants are kept away from the working area for the duration of the visit and for any recommended period afterwards, for example while treatments or chemicals are active.

6.3 The Client is responsible for the ongoing care, watering and maintenance of lawns, plants and landscaping after completion of the Services, unless an ongoing maintenance agreement is separately agreed in writing.

7. Payments and Invoicing

7.1 Unless otherwise agreed, payment is due immediately upon completion of the Services on the day of the visit.

7.2 For larger projects or ongoing contracts, Gardeners Hoxton may require a deposit or staged payments. The amount and timing of such payments will be stated in the quotation or booking confirmation.

7.3 Payment methods accepted will be communicated to the Client. Cash payments may be subject to additional verification requirements for security and accounting purposes.

7.4 Where an invoice is issued with a specified due date, payment must be received by that date. If payment is not received when due, Gardeners Hoxton reserves the right to charge interest on the overdue amount at the statutory rate and to recover any reasonable costs of collection.

7.5 Gardeners Hoxton retains ownership of any materials or goods supplied until full payment has been received. We reserve the right to remove or reclaim materials if payment is not made, where it is lawful and reasonable to do so.

8. Cancellations and Rescheduling

8.1 The Client may cancel or reschedule a booking subject to providing reasonable notice. Unless otherwise specified, we request at least 48 hours’ notice for cancellations or changes.

8.2 If less than 24 hours’ notice is given, Gardeners Hoxton reserves the right to charge a late cancellation fee, which may be up to the equivalent of the first hour of labour or a reasonable proportion of the quoted price.

8.3 Gardeners Hoxton may cancel or reschedule a booking due to severe weather conditions, staff illness, safety concerns, unexpected transport disruptions, or other events beyond our reasonable control. In such cases, we will seek to offer an alternative date as soon as reasonably practicable.

8.4 Where a deposit has been paid, the terms relating to the refund or forfeiture of the deposit in the event of cancellation will be set out in the quotation or booking confirmation. If no specific terms are stated, deposits may be retained to cover reasonable costs and losses incurred.

9. Waste Removal and Environmental Regulations

9.1 Gardeners Hoxton complies with applicable UK environmental and waste regulations. Green waste and other materials will only be removed from site where this service has been specifically included in the quotation or agreed at the time of booking.

9.2 If waste removal is not included, the Client is responsible for disposing of all waste generated by the work, including green waste, soil, turf, branches and packaging.

9.3 Where waste removal is included, Gardeners Hoxton will transport and dispose of waste at appropriate facilities, in accordance with relevant legislation. Additional charges may apply for large volumes of waste, soil, rubble or hazardous materials.

9.4 Gardeners Hoxton is unable to remove certain types of waste, including hazardous, chemical or contaminated materials. The Client must inform us in advance if any such materials are present on site.

10. Use of Chemicals and Treatments

10.1 Where weedkillers, pesticides, fertilisers or other treatments are used, Gardeners Hoxton will endeavour to use products appropriate to the task and in accordance with manufacturer instructions and applicable regulations.

10.2 The Client must follow any aftercare instructions provided, including keeping pets and children away from treated areas for the recommended period. Gardeners Hoxton accepts no liability for issues arising from failure to follow these instructions.

10.3 Some treatments may require repeat applications for best results. The effectiveness of treatments may be influenced by weather conditions, existing soil and plant health, and ongoing maintenance by the Client.

11. Liability and Insurance

11.1 Gardeners Hoxton will carry appropriate public liability insurance for the Services offered. Details of cover can be provided on request.

11.2 We will take reasonable care to avoid damage to property while carrying out the Services. However, minor damage or disturbance that is reasonably incidental to normal gardening work shall not be considered a breach of contract.

11.3 Gardeners Hoxton shall not be liable for any indirect, consequential or economic loss, including loss of enjoyment, loss of profit, or loss of anticipated savings, arising out of or in connection with the Services.

11.4 Our total liability to the Client for any loss or damage arising under or in connection with the Agreement, whether in contract, tort or otherwise, shall not exceed the total amount paid or payable by the Client for the specific Services giving rise to the claim, except where such limitation is not permitted by law.

11.5 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.

12. Delays and Events Beyond Our Control

12.1 Gardeners Hoxton shall not be held responsible for any delay or failure to perform the Services due to events beyond our reasonable control, including severe weather, accidents, illness, equipment failure, transport disruption or acts of third parties.

12.2 Where such events occur, we will aim to notify the Client as soon as is reasonably practicable and to arrange a new appointment date or alternative solution where possible.

13. Complaints and Quality Issues

13.1 If the Client is dissatisfied with any aspect of the Services, they must notify Gardeners Hoxton as soon as possible and, in any event, within 7 days of completion of the relevant work.

13.2 We will investigate any complaint and, where we consider it justified, may offer to rectify the issue, provide advice on remedial action, or propose another reasonable solution. Any such remedy will be subject to the Client having complied with relevant aftercare instructions.

13.3 Normal wear and tear, plant failure due to lack of watering or maintenance, pest damage, extreme weather, or conditions beyond our control are not covered by any guarantee and shall not give rise to liability on the part of Gardeners Hoxton.

14. Intellectual Property

14.1 Any designs, planting schemes, plans, drawings or written materials created by Gardeners Hoxton remain our intellectual property unless otherwise agreed in writing.

14.2 The Client is granted a non-exclusive licence to use such materials solely for the purposes of implementing and maintaining their garden at the property where the Services are provided.

15. Data Protection and Privacy

15.1 Gardeners Hoxton will collect and use personal information about the Client only to the extent necessary to manage bookings, deliver Services, and handle payments and communications.

15.2 We will take reasonable steps to keep personal data secure and to comply with applicable data protection laws in the United Kingdom.

16. Amendments to These Terms

16.1 Gardeners Hoxton reserves the right to amend these Terms and Conditions from time to time. The version in force at the time of your booking or quotation will normally apply to that booking, unless a change is required by law or by mutual agreement.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Gardeners Hoxton.

18. General Provisions

18.1 If any provision of these Terms and Conditions is held to be invalid or unenforceable by a court or other competent authority, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall remain in full force and effect.

18.2 No failure or delay by Gardeners Hoxton in exercising any right or remedy shall operate as a waiver of that or any other right or remedy.

18.3 The Agreement is between Gardeners Hoxton and the Client. No person other than a party to the Agreement shall have any rights to enforce any of its terms.
